Terms and Conditions for Participation in Tours and/or Photography Trips by Snijders Photography

Definitions

  • Snijders Photography: Legal entity offering travel services.

  • Participant: A natural or legal person who registers to participate in a tour or trip organized by Snijders Photography.

  • Tour: A trip organized and conducted by Snijders Photography.

Scope

These terms and conditions apply to agreements concerning photography trips between Snijders Photography and the Participant, even after the termination of the agreement, unless both parties expressly and in writing agree to deviate from these terms.

Registration and Formation of Agreement

By registering for a Tour or Photography Trip, an agreement between the Participant and Snijders Photography is established. Upon registration, the Participant will receive a confirmation of participation.

Prices

The price applicable at the time of registration for a Tour or Photography Trip is the price listed on the Snijders Photography website. The description of the Tour or Photography Trip includes what is covered in the price.

If VAT applies to a Tour or Photography Trip, the listed price includes the applicable VAT rate. Prices will be adjusted in the event of changes in the VAT regime and/or applicable VAT rates.

Cancellation by Participant

The Participant may cancel up to 90 days before the start of the Tour or Photography Trip. In case of cancellation between 90 days and 45 days before the start, 50% of the total amount is due.

If canceled within 45 days before the start of the Tour or Photography Trip, 100% of the total amount is due.

Participants may provide a substitute in all cases.

Cancellation by Snijders Photography

Snijders Photography reserves the right to cancel a trip. If Snijders Photography cancels a Tour or Photography Trip, the Participant will receive a 100% refund of the participation fee within 5 working days.

Invoices and Payment

Immediately after registration, the Participant will receive a confirmation by email. A down payment of 20% of the total participation fee is required. The timing of when this amount must be credited to Snijders Photography’s account will be agreed upon between the Participant and Snijders Photography.

The remaining 80% must be paid no later than 90 days before the start of the Tour or Photography Trip.

If the Participant fails to pay or fails to pay on time, all resulting costs for Snijders Photography will be borne by the Participant, including all judicial and extrajudicial costs.

The VAT number of Snijders Photography will be stated on the issued invoices.

Changes to Terms and Conditions

In the event of changes to the Terms and Conditions, the old conditions will continue to apply to existing agreements.

Liability

Participation in Tours or Photography Trips is at the Participant’s own risk. Snijders Photography is not liable for damage, theft, injury, or accidents that occur to the Participant, regardless of the cause or negligence that may have occurred.

No Liability for Theft, Accidents, or Injury
Snijders Photography, its employees, guides, and others involved in the organization of the photography trips are not liable for any loss, theft, damage, accidents, or injury that may occur during the trip. This includes, but is not limited to, damage to personal property, theft of equipment or other belongings, and injuries resulting from activities during the trip.

Insurance
Participants in the Tours or Photography Trips are responsible for arranging appropriate travel and cancellation insurance that covers, among other things, theft, loss of property, medical expenses, and accidents. It is strongly recommended to check whether the insurance also covers the specific activities undertaken during the trip.

Personal Responsibility
Participants take part in the Tours or Photography Trips at their own risk. It is the responsibility of the Participant to take all necessary precautions to ensure their personal safety, including but not limited to following the instructions of guides or staff, carefully handling personal belongings, and assessing their own physical and mental capabilities to participate in activities.

Exclusion of Claims
By participating in the Tours and/or Photography Trips of Snijders Photography, the Participant accepts these terms and waives all possible claims against Snijders Photography, its employees, guides, or other parties involved for damage, loss, or injury resulting from participation in the trip.

Disputes and Applicable Law

In the event of disputes between the Participant and Snijders Photography, efforts will be made to reach a resolution through mutual agreement. If this fails, disputes will be submitted to the competent court of the Court of Maastricht. Dutch law applies to the agreement.
